1. Purpose of Agreement

This Agreement sets out the terms under which Career Indaba® Magazine (a publication of Career Indaba® ) collects, publishes, and uses contributor content, stories, and related materials for editorial, promotional, and archival purposes.

By submitting content, images, or information, you (“the Contributor”) acknowledge and agree to these terms.

2. Grant of Rights

The Contributor hereby grants Career Indaba® Magazine:

  • A non-exclusive, worldwide, perpetual, royalty-free license to use, reproduce, edit, publish, and distribute their submitted story, biography, images, recordings, and related materials (“the Materials”) in print, digital, audio-visual, broadcast, and social-media formats.
  • The right to use the Contributor’s name, likeness, professional title, and organisation affiliation in connection with such publication.
  • Permission to store the Materials in Career Indaba® Magazine’s Living Digital Archive, which may be referenced, republished, or featured in future issues, media projects, and exhibitions.

3. Editorial Control

Career Indaba® Magazine reserves the right to:

  • Edit the Materials for clarity, length, or style while maintaining accuracy and respect for the Contributor’s voice.
  • Decide whether, when, and in which format the Materials are published.

No guarantee of publication is implied.

4. Ownership & Copyright

  • The Contributor retains copyright to their original text and images but grants the licence described above.
  • Where the Contributor is not the copyright holder (e.g., professional photography), they confirm that all necessary permissions or usage rights have been obtained.
  • All compiled layouts, designs, and editorial collections remain the intellectual property of Career Indaba Media Network.

5. Commercial and Promotional Use

The Contributor understands and agrees that:

  • Career Indaba® Magazine and its affiliates may derive commercial or promotional benefit from the publication, marketing, and sponsorship of the Materials.
  • No financial compensation is due unless otherwise specified in a separate written agreement.
  • The Materials may be used to promote Career Indaba® Magazine, its events, campaigns, or affiliated brands, always in a respectful and professional context.

6. Third-Party Sharing & Partnerships

The Contributor consents to limited sharing of the Materials with authorized Career Indaba® partners (e.g., SETAs, corporates, or media platforms) strictly for editorial or promotional purposes connected to the magazine.
Career Indaba® will not sell or license the Materials to third parties for unrelated commercial use without written consent.

7. Data Protection (POPIA Compliance)

Career Indaba® Magazine undertakes to:

  • Collect and process personal data lawfully and securely under the Protection of Personal Information Act (POPIA).
  • Use data solely for editorial, communication, and archival purposes.
  • Store data in password-protected systems accessible only to authorized personnel.
  • Honour any written request to correct or remove personal information from its records, except where required for archive preservation.

8. Contributor Warranties

The Contributor warrants that:

  • All information provided is accurate and truthful.
  • They have full authority to grant the rights described.
  • Publication of the Materials will not infringe on any copyright, privacy, or third-party rights.

9. Indemnity

The Contributor indemnifies Career Indaba® Magazine, its officers, employees, and partners against any claims arising from breach of the above warranties or misuse of unlicensed materials provided by the Contributor.

10. Withdrawal of Consent

A Contributor may withdraw consent for future use by submitting a written request to INFO@careerindaba.org Such withdrawal will not affect material already published or archived before the request date.

11. Governing Law

This Agreement is governed by the laws of the Republic of South Africa, and any dispute shall fall under the jurisdiction of South African courts.
